When we use capitalized words or phrases in these Terms of Service, they have the following meanings:
"Appointment" means any appointment booking for one or more services from a Clinic made through the Odontomy Platform, including those updated, rescheduled or cancelled;
"Cancellation Policy" refers to a policy that is included in the Sales Terms of a Clinic's Appointment whereby a Clinic may charge you (through the Clinic's Payment Services) a certain fee for a cancelled Appointment, which may be up to 100% of the value;
"Customer" and "you" mean you, the user of Odontomy Services or the purchaser of any Clinic Service;
"Confirmation" means a written confirmation that we provide you regarding an Appointment or Order, by email or the Odontomy Platform;
"Deposit Policy" refers to a policy that is included in the Clinics' Sales Terms whereby a Clinic may request that you (through Odontomy's Payment Services) purchase a credit at the time you make such an Appointment;
"Odontomy Account" means an account you create on the Odontomy Platform, which contains information such as your name, appointment and order history, and contact information;
"Odontomy Appointment Services" refers to all appointment booking services, including the creation, updating, rescheduling, and cancellation of appointments, provided through the Odontomy Platform;
"Odontomy Payment Services" refers to the online and in-app payment service available to selected Clinics on the Odontomy Platform;
"Odontomy Platform" means, collectively: (a) the odontomy.com website, accessible through any web browser (our "Site"), (b) our mobile app published in the Apple Store and Google Play Store and downloaded and installed by you on your device (our "App"), and (c) the web interface owned and provided by Odontomy, which a Clinic may incorporate into their own website or social media channels (the "Odontomy Widget");
"Odontomy Services" refers to all information, recommendations, and/or services that Odontomy provides you through your use of the Odontomy Platform, including the Odontomy Platform, Odontomy Appointment Services, and Odontomy Payment Services, and the Clinic Profiles;
"No-Show Policy" refers to a policy that is included in the Sales Terms of an appointment whereby a clinic may charge you (through Odontomy's Payment Services) a certain fee for not showing up at the place at the time indicated in the Appointment, which may be up to 100% of the value of the Appointment;
"Order" means any order for products ("Products") from a Clinic through their store on the Odontomy Platform;
"Clinic Contract" refers to any contract between you and the corresponding center for their services that you book through the Odontomy Platform, including the Clinic's Sales Terms (as provided to you before confirming your Appointment/Order);
“Clinic Credit” means a credit that the Customer purchases through Odontomy Services in order to provide a prepayment to a Clinic regarding a Clinic Service.
"Clinic Profile" means a Clinic's web page(s) on the Odontomy Platform, which may include information about their Clinic services and, where applicable, their Clinic store;
"Clinic Services" refers to any product, good and/or service from a Clinic offered for purchase or reservation on the Odontomy Platform, including the fulfilment of any Appointment, Coupon, or Order;
"Clinic Sales Terms" refers to the date, time, price, Clinic Services, discount, location and any other information or terms and conditions (including any Deposit Policy, Cancellation Policy, No-Show Policy, or a return and refund policy) provided through the Odontomy Platform at the time the Customer makes an Appointment.
"Clinic Coupon" refers to a coupon (with the details of a Clinic offer and a unique security code) issued by the Clinic through the Odontomy Platform that, when presented to the corresponding Clinic in physical or electronic form, entitles the coupon holder to receive the Clinic's Offer, subject to any Clinic Contract.
"Clinic" means a third-party provider of goods and services, which offers for sale on the Odontomy Platform;
"Clinic Payment Service" means when an Appointment/Order is made on the Odontomy Platform but payment is made at the Clinic's premises (and not online using the Odontomy Payment Services);
"Payment Processor" refers to the third-party payment processors that back Odontomy in the provision of the Odontomy Payment Services;
Odontomy offers a way to connect you with Dental Clinics, which offer a range of products and services related to dental care. The Odontomy Platform allows you to make an Appointment for a Clinic Service, an Order for a Clinic Product, and pay directly for your Services and Orders. Odontomy does not operate any Clinic, does not provide any Aesthetic Clinic Services, nor fulfills any Product Orders.
By using Odontomy Services, you enter into a contract with Odontomy under these Terms of Service. However, your contract for the Clinic Services is only between you and the Clinic.
Odontomy acts only as an intermediary between you and the Clinics, including acting as an agent for each Clinic to arrange and conclude your Appointment/Order.
When you pay for an Appointment/Order on the Odontomy Platform, we receive the payment as a commercial agent on behalf of the corresponding Clinic and this releases your debt to the Clinic for that Appointment/Order. This does not apply to any In-Store Payment Service.
If you use the Odontomy Platform to book or order any Clinic Service or Product, you also enter into a Contract with the corresponding Clinic, including the Clinic's Sales Terms.
The provision of the Clinic Services by the Clinics and the fulfillment of any Appointment/Order is subject to the Clinic Contract. Odontomy is not a party to it.
Our Clinics are obliged to provide the Clinic Services as set out in the corresponding Clinic Contract (including the Clinic's Sales Terms).
We require our Clinics to ensure that all information provided by them for the Odontomy Platform is accurate, complete, and not misleading in any way. However, we cannot verify the information that Clinics provide to us. It is the responsibility of each Clinic to ensure that all Clinic Services listed on the Odontomy Platform are available and accurately described. The descriptions and/or images of the Clinic Services on the Odontomy Platform are for illustrative purposes only, and the actual Clinic Services may vary from those descriptions and/or images.
If you are a consumer, you have legal rights in relation to services that are not performed with reasonable care and skill or which do not match their description. You can get advice on your legal rights from your local Citizen Advice Bureau or trading standards office. Nothing in these Terms of Service will affect these legal rights.
To make any Appointment/Order through the Odontomy Platform, you can register as a guest or you can create an Odontomy Account by registering with Odontomy and providing certain information, including your name, mobile phone number, and payment method information, and any password you set.
You must provide accurate and complete information to Odontomy, and keep this information updated through the Platform. Odontomy may verify the information you provide and may refuse use of the Services or the Odontomy Platform without providing reasons.
To make the most of using Odontomy, you can:
It is your responsibility (or the responsibility of the person receiving the Clinic Services) to communicate any health-related condition or special needs to the Clinic in advance that may affect or be affected by any Clinic Service (for example, without limitation, allergy information, and health issues). This includes checking, before purchasing any Product, that it is suitable for you and requesting more information from the Clinic selling the Product if necessary.
If you (or the corresponding recipient of the Clinic Services) do not disclose such information to the corresponding Clinic, or do not verify the suitability of a Product (including verification with the corresponding Clinic), neither Odontomy nor the corresponding Clinic will be liable to you (or the recipient of the Clinic Services) for any injury, loss or damage resulting from the Clinic Services that could have been reasonably avoided if you (or the recipient of the Clinic Services) had disclosed (or checked or requested) that information before receiving the Clinic Services.
In relation to your use of Odontomy Services, Odontomy may send you electronic service messages. These electronic messages can be sent for various reasons, including for security reasons (e.g., to verify that your smartphone is connected to the phone number you entered when registering) and issues related to an Appointment/Order you made (e.g., if the Clinic updates an Appointment, or is out of an item you ordered, you may be notified by text message).
You agree to receive automated text messages from Odontomy and its Clinics to the phone number you provided when registering for the service. Furthermore, you agree that these messages may include promotional content, such as information about your account and Appointment/Order. Your agreement to receive promotional texts is not a condition for using the service.

The Odontomy Platform allows you to select which Clinic Services you would like to receive and make an Appointment/Order for that Clinic Service. You can verify and correct any error before confirming your Appointment/Order. We will disclose the Clinic's Sales Terms (including any Deposit Policy, Cancellation Policy, or Absence Policy) before your confirmation. Read and verify all the details of your Appointment/Order and the applicable Clinic Sales Terms before confirming your Appointment/Order.
When you make an Appointment/Order, we (as the Clinic's commercial agent) will send your request to the Clinic, and the Clinic Contract will be formalized when we send you a Confirmation. All Clinic Services shown on the Odontomy Platform are subject to availability. We may accept or reject each Appointment/Order on behalf of the Clinic. Your Confirmation is your receipt from Odontomy, and will be sent by email or SMS to the contact information provided in your Odontomy Account, upon confirming an Appointment/Order. If you need a tax receipt, you should contact the Clinic directly.
When you make an appointment, you will need to arrive at the Clinic's place of business to receive the Clinic Services. The place of business will be indicated in the Clinic's Sales Terms.
Clinics may issue Coupons that can be used for Clinic Services, or our Clinics may allow you to purchase Coupons to use later against their services. The issued Coupons are at the discretion of the Clinic.
If you purchase a Coupon this is subject to the Clinic's Sales Terms that were provided to you at the time of purchase. The provision and redemption of Clinic Vouchers by the Clinics are subject to the Clinic Contract (including the Clinic's Sales Terms). Odontomy is not part of the Contract you have with the Clinic, and is not responsible for Clinic Vouchers. Unless the offer terms set a fixed or minimum period during which an offer will be available, it can be withdrawn at any time, unless you have already placed an order for an Appointment/Order based on the offer and we have sent you a confirmation notice.
The prices and any shipping or processing charge for any Appointment/Order will be those quoted on the Odontomy Platform.
The final price you pay for an Appointment may be adjusted to reflect any additional good or service you purchase from the Clinic at the time of receiving the Clinic Services.
Clinics may also offer discounts that would be reflected in the final amount to pay.
You may wish to tip the Clinic for your appointment. You will be given this option through a notification on the Odontomy Platform after your appointment. Tips are added to the purchase price you pay for the appointment itself and are at your sole discretion. Odontomy will charge the payment on behalf of the Clinic, as their limited collection agent, and the payment of the tips will be considered a direct payment from you to the Clinic. We will share your name with the Clinic when we notify them of the tip. Subject to payment processing fees, the Clinic will receive 100% of any payment (tip) you choose to make.
You agree that you will provide Odontomy with a valid payment method and that you will pay for all Clinic Services you purchase at the Clinic. You can pay for Appointments and Orders through Odontomy Payment Services or directly with the Clinic as an In-Store Payment Service.
If you choose to use Odontomy's Payment Services, Odontomy will charge you on behalf of the Clinic (as their commercial agent) the total amount of your Appointment/Order (including applicable taxes and additional fees). To complete Odontomy's Payment Services, we use the payment method you provide us and in the currency indicated in the Confirmation. Currency conversion costs or other charges incurred by you will be your responsibility in addition to the payment you have made to us. When Odontomy receives your payment for the Clinic Services, this will cancel your debt with the corresponding Clinic for the corresponding Appointment/Order.
You may have the option to select certain appointments/orders as an in-store payment service. This means that you can make an Appointment/Order without using Odontomy's Payment Services, and then pay directly to the Clinic for the Clinic Services with cash, credit card, or other payment instrument accepted by the Clinic. This option will only appear for Clinics that enable In-Store Payment Services and may not appear for some Clinics.
Odontomy uses a third-party payment processor (the "Payment Processor") to link the payment card you provide to the Odontomy Platform. The processing of payments or credits, as applicable, in relation to your use of the Odontomy Platform will be subject to the privacy policies, terms and conditions and other terms of our Payment Processors and your credit card issuer (in addition to these Terms of Service). Odontomy takes reasonable precautions to ensure that Odontomy Payment Services are available and functioning at all times, but cannot guarantee continuous, uninterrupted, or secure access to Odontomy Payment Services, nor can we guarantee that the installation is free of viruses or errors.
Odontomy is not responsible for any errors from the Payment Processor. Access to Payment Processing may occasionally be restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will try to provide reasonable notice of any scheduled disruption and will do our best to restore the facilities as soon as reasonably possible.
The Clinic is solely responsible for any indirect tax (for example, sales tax, VAT, GST or service tax) on the total value of an Appointment/Order, plus any adjustment for additional goods or services sold or discounts applied, where applicable.
Apart from VAT or other applicable sales taxes that are included in the price shown on the Odontomy Platform, Odontomy does not charge you taxes on Orders, as the Clinic Services are provided by the Clinic, not by Odontomy. If you place an order through the Odontomy Platform, we will provide a tax invoice through the Odontomy Platform. If you place an order directly through a Clinic, the Clinic will provide a tax invoice upon request.
We add taxes to all Products in an Order and apply the highest applicable Product tax for shipping, when applicable (i.e., if the Products within an Order have different tax rates, the highest tax rate will apply to all Products in that Order).
If you wish to reschedule your Appointment (e.g., time/date) in whole or in part after you have received a Confirmation, you can do so through the Odontomy Platform or by contacting the corresponding Clinic directly.
You can only reschedule your Appointment if your Appointment is not to be performed within a period of time (e.g., 24 or 48 hours) determined by the Clinic and set out in the Clinic's Sales Terms. The interval between the time when you can reschedule your Appointment and the start time of your scheduled Appointment will be determined independently by each Clinic and will be informed to you at the time of making your Appointment. You should review and understand the Cancellation Policy before confirming your appointment on the Odontomy Platform. Please note that your ability to reschedule your Appointment will be subject to the Clinic's availability during the time you wish to reschedule.
In addition to your other legal rights, under certain circumstances, you may be entitled to cancel a Clinic Contract, as set out in this section of the Terms of Service.
Odontomy reserves the right to partially or totally restrict your access to Odontomy Services or the Odontomy Platform when any of the following situations occur:
In addition (since the Services are sold by our Clinics and not by Odontomy), our Clinics may impose additional restrictions on who can purchase and book the Clinic Services they offer. In particular, a Clinic may:
These restrictions are determined solely by the Clinics, and we cannot provide you access to these Clinic Services.
We are not responsible to you for the provision or non-provision of the Clinic Services and/or Products. The Clinic is responsible for the fulfillment of all Services and Products offered by them.
You agree to indemnify and release Odontomy (and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers, and directors), from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees and costs) arising out of or related to:
You can terminate your use of Odontomy services at any time by closing your Odontomy Account through the Odontomy Platform (following the instructions on the Odontomy Platform) and, if you have used the App, by deleting the installed App on your device.
Odontomy can terminate your use of the Odontomy Services at any time without prior notice and with immediate effect (by disabling your use of the Odontomy Platform) for any reason, including, if you: violate or infringe any term of these Terms of Service, or in Odontomy's opinion, misuse the Odontomy Platform.
Use of the Odontomy Platform by Customers is free. Odontomy reserves the right to introduce a fee for the use of the Odontomy Platform. If Odontomy decides to introduce such a fee, Odontomy will inform you in advance and allow you to continue or stop using Odontomy services.
The use fee of the Odontomy Platform by the Clinics is indicated at the time of creating an account on the platform. If Odontomy decides to modify such a fee, Odontomy will inform you in advance and allow you to continue or stop using the Odontomy services.
These Terms of Service were last updated on May 19, 2023.
We may update these Terms of Service from time to time and we will post any changes on this page. Odontomy may modify or replace any of these Terms of Service, or change, suspend or discontinue the Odontomy Services (including, among others, the availability of any feature, database or content) at any time.
We will notify you by posting a notice on the Odontomy Platform, or by sending you a notice through the Odontomy Platform, your Odontomy account or by email. If we make substantial changes, we will notify you by email or pop-up windows on the website within our Platform.
Your continued use of the Odontomy Platform after posting the changes will mean that you accept and agree with the changes. As long as you comply with these Terms of Service, Odontomy grants you a personal, non-exclusive, non-transferable, and limited privilege to enter and use the Platform.
Odontomy may also impose limits on certain features and services or restrict your access to parts or all of the Odontomy Services without prior notice or liability. Such modification will not apply to any already made Reservation/Order.
We care about your experience and want to ensure we maintain the highest possible standards.

If you contact us at info@odontomy.com, we may communicate with the Clinic to try to resolve the issue. If we cannot resolve the issue after contacting the Clinic, and if we consider it fair in all circumstances, we may, at our entire discretion and always as a last resort, choose to refund you the disputed/complained about amount. These refunds will be processed through Odontomy Payment Services.
While we take all complaints about our Clinics very seriously and will always do everything possible to help resolve them, we are not liable to you for the Clinic Services and have no obligation to provide you with a refund or any other reward if you are not satisfied with the Clinic Services.
